The National GCC Governing Documents

The Wild West

All owners at the National GCC received a copy of all the governing documents at the time of their purchase. Buyers have a period ot time to review and cancel their purchase agreement if they learned something they were not aware of. But only a small number of owners ever actually take the time to read the documents. Consequently, the situation can resemble the lawless nature of the wild west, with owners acting based on their own assumptions of what is permissible. That is until they get corralled.

The National Golf and Country Club governing documents, for both the POA and Golf Club (See Community Structure) are public and include.

  • Declaration of Covenants, Conditions and Restrictions.
  • Articles of Incorporation.
  • Bylaws
  • Rules and Regulations as establish by the Board of Directors

POA Document Highlights

A sampling of items from the 79 pages of the National Golf and Country Club at Ave Maria (POA) documents:

  • Each home shall be occupied by only one family and their temporary guests.
  • Non-married co-owners must declare one as the Primary Occupant, and the other will be considered a guest.
  • No lease is to be less than 30 days.
  • If the home is leased, no one but the lessee and the lessee's spouse, and their unmarried children who live with their parents may occupy the home during a lease.
  • No member shall permit a home to used in a manner that would be a nuisance to another, or be inconsistent with the highest standards for a first class residential development.
  • Owners can not park commercial trucks, motorcycles or recreation vehicle other than in an enclosed garage.
  • Golfers have the right to recover errant golf balls landing on any lot.
  • Owners accept inherent risks associated with living near a golf course.
  • There are three board members that Lennar appoints, until such time 50% of homes have been sold, at which time the owners will elect a board member.
  • Owners will elect all board members within 90 days of when 90% of homes are sold (Turnover).

Common Rule Viloations

New owners often arrive, without an understanding of the community rules. Common violations, which get quickly corrected include:

  • Walking the golf course cart paths, out for an early morning, daytime or evening stroll, despite posted signs stating that it is not allowed.
  • Street parking over night.
  • Owner's illegal dumpster dumping and trespass. Dumping refuse in the dumpsters of the builder, or a condo association they are not a member of.
  • Leasing for less than 30 days - $1,000 fine.
  • Leasing to unrelated tenants - $1,000 fine.
  • Loud noises either from condo or single family homes, that disturbs neighbors or players on the golf course - not allowed.
  • Speeding.
  • Not applying to the Architectural Control Committee (ARC) for exterior improvements.
  • Dogs constantly barking, not the occasional barking.
  • Golf carts not stored in a garage overnight.
  • Overnight commercial truck parking.
